Claimable Drive

Claimable Drive

Terms of Use

Last updated: October 11, 2026

1. What These Terms Cover, and Who We Are

These terms (the "Agreement") are a legal agreement between you and the operator of Claimable Drive ("Drive", "the app"), governing your use of the app. Drive is operated as a sole proprietorship by Vlad Bors, carrying on business as "Claimable", based in British Columbia, Canada. "We", "us" and "our" mean that operator.

Installing Drive, creating an account, or using the app is agreeing to this Agreement. If you do not agree, do not install or use the app.

Drive signs in with a Claimable account. The Claimable End-User License Agreement governs that account, the web app, subscriptions bought on the web, support and the website, and applies in full to your use of Drive. This Agreement is specific to what the app adds: the licence to run it on your phone, the free allowance, the auto-renewing subscription sold through the App Store, who is responsible for the logbook, and Apple's own required terms. Where the two overlap, this one is the more specific and governs your use of the app.

How Drive handles your location and everything else it records is set out in the Claimable Drive Privacy Policy, which forms part of this Agreement.

2. The Licence

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Drive on an Apple-branded device that you own or control, for your own record-keeping, in accordance with this Agreement and the Usage Rules set out in Apple's App Store Terms of Service. Where Apple's Family Sharing or volume purchasing applies, the licence extends as those rules allow. The licence is to use the app, not to own it; the app, its design, its code and its branding remain ours.

You may not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent applicable law expressly permits it
  • Copy, rent, lease, sell, sublicense, or redistribute the app
  • Remove or obscure any notice of ownership in the app
  • Use automated means to access our servers through the app, or use the app to build a competing product

3. Your Account, and Who May Use Drive

  • You must be at least 18 years old
  • The account is yours: keep the credentials to yourself and tell us promptly of any unauthorized use
  • You are responsible for everything done under your account
  • One book, one business. A single account records one person's driving; a second business or a second driver needs a second account

4. Recording Another Person's Driving

Drive records where the phone goes, so it must only ever be the phone of the person whose logbook it is. Do not install Drive on somebody else's phone, and do not use it to record somebody else's movements without their knowledge and their freely given consent. That includes an employee, a contractor, a family member, or anyone driving a vehicle you own. Drive is a logbook a driver keeps for themselves. It is not a fleet-tracking or staff-monitoring tool, we do not offer it as one, and using it as one is a breach of this Agreement and may breach privacy or employment law where you are.

5. The Free Allowance, and the Subscription

What Is Free

Thirty drives each calendar month are recorded in full, for as long as you use the app, with no subscription and no card. The allowance is counted against the month the drive happened in, on your phone's own calendar, and it does not roll over. Every drive recorded under it is yours in full and stays yours, with its route, its addresses and its distance, whether you ever subscribe or not.

Recording stops when the allowance runs out. Past the thirty, the app stands its recorder down until you subscribe or the month turns, and it tells you the day it will start again. A drive already being recorded when the allowance runs out is finished and kept.

Drives you take while recording is paused are not recorded, and they cannot be recovered afterwards. There is nothing stored to hand back: subscribing later starts recording again rather than filling in the gap. This is a change from earlier versions of these terms, which said recording never stopped at the allowance and that drives past it were kept until something paid.

What a Subscription Buys

A Drive subscription opens every drive on the account, past and future, for as long as it is active. It is sold in monthly and annual terms; the price and the term are shown in the app at the moment of purchase and are charged in your App Store region's currency.

Drive and Claimable Pro are two products. A Drive subscription is Drive alone: it includes reading the figures off a car receipt you photograph in Drive, and it does not include Claimable's receipt scanning for other expenses, the tax engine or GST filing. A Claimable Pro subscription does include Drive, and so does a Claimable trial while it is running, so nobody pays twice.

Auto-Renewal, and Cancelling

  • Payment is charged to your Apple ID account at confirmation of purchase. We never see your card.
  • The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period, at the price for the term you chose.
  • You manage and cancel the subscription in your Apple ID account settings on your device, not in Drive and not by writing to us. Deleting the app does not cancel it, and neither does closing your Claimable account.
  • Cancelling stops the next renewal. The period you have already paid for runs to its end; a partial period is not refunded.
  • When a subscription ends, your logbook stays yours: every drive and every trip is kept, you can still read and export them, and recording carries on under the free allowance. Drives past the allowance close again until you subscribe.
  • The subscription belongs to the Apple ID that bought it, not to the phone, so "Restore purchases" in the app reclaims it on a new device.

Refunds, and Price Changes

Purchases made through the App Store are refunded by Apple, under Apple's policies, through Apple's own request process. We cannot issue a refund for an App Store purchase. If Apple changes the price of a subscription, Apple asks you to consent before the next renewal, and a subscription you do not consent to is not renewed.

6. What the Recorder Does, and What It Cannot Promise

Drive records a drive when your phone's own motion detection says you are in a moving vehicle, and it is built to do that without you touching anything. It is best-effort, and it depends on things we do not control:

  • The Location and Motion permissions being granted at the levels the app asks for
  • iOS deciding to wake the app in the background, which it may delay or decline
  • The phone being on, charged, and not in a mode that suspends background activity
  • Satellite reception, which is poor in tunnels, parkades and dense downtown blocks

So a drive can be missed, cut short, or measured a little long or a little short. The app tells you what it has and has not caught, and it lets you type in a drive it missed, but it cannot know about a drive it never saw.

The logbook is yours, and so is the duty to keep it. Reviewing the queue, confirming each drive as business or personal, giving business trips their purpose, adding what the recorder missed, and keeping your odometer readings, are yours to do. We do not verify any of it.

7. Not Tax Advice

DRIVE IS A RECORD-KEEPING TOOL. IT DOES NOT PROVIDE TAX, LEGAL, FINANCIAL OR ACCOUNTING ADVICE.

The app refers to the requirements of the Canada Revenue Agency and, where it is used outside Canada, to those of other tax authorities, for informational and organizational purposes only. Your business-use percentage is arithmetic over the decisions you made about your own drives. Drive does not file anything on your behalf, does not decide whether a trip is deductible, does not guarantee that any figure it shows is correct or current, and does not replace an accountant. No tool can guarantee that a tax authority will accept a logbook, and we do not.

You are solely responsible for what you claim and for verifying every figure before it reaches a return.

8. Driving Safely Is Your Responsibility

Drive is designed so that nothing needs doing while the car is moving: recording starts and stops on its own, and every decision waits for you in a queue. Do not interact with your phone while driving. Obey the distracted-driving laws where you are, mount and operate the device lawfully, and never let the app take your attention off the road. You are responsible for your own driving, and we are not liable for anything that follows from using a phone while operating a vehicle.

9. Your Data

Your drives, your logbook and everything you enter remain yours. You grant us a limited licence to store and process them only to provide the service to you. You can export them at any time and delete any of them at any time; closing your Claimable account deletes them at once, so export first. They then leave our nightly backups as they age out, about a month later, and we never restore them from there. What is recorded, where it is stored, who else ever sees it, and how long each thing is kept, are set out in the Drive Privacy Policy.

Closing your account does not cancel an App Store subscription; only you can do that, with Apple.

10. Availability and Changes to the App

Drive talks to our servers, and we do not guarantee uninterrupted access. We may change, add or remove features, and we may stop supporting older versions of the app, in which case you may need to update to keep using it. Where a change materially reduces what the app does for a paying subscriber, we will tell you before it takes effect.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

In particular, we do not warrant that:

  • Every drive you take will be detected, recorded, or measured accurately
  • Addresses looked up for the ends of a drive will be correct
  • The app will be error-free, uninterrupted, or available at any given moment
  • A logbook kept with Drive will satisfy the requirements of the CRA or any other tax authority in your particular case

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING:

  • A drive that was not recorded, or a distance recorded inaccurately
  • A deduction missed, disallowed, or incorrectly claimed
  • Penalties, interest or reassessments imposed by any tax authority
  • Loss of data, service outages, or a security incident
  • Anything arising from using a phone while driving

Our total aggregate liability under this Agreement will not exceed the greater of the amount you paid us, or paid Apple for Drive, in the twelve months before the event giving rise to the claim, and twenty Canadian dollars. Nothing in this Agreement limits liability that cannot be limited by law, including for fraud, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold us harmless from any claim, liability, damage, loss or expense (including reasonable legal fees) arising out of your use of the app, your tax filings, your driving, your recording of another person, or your breach of this Agreement.

14. Apple

Drive is distributed through the Apple App Store, and the following apply to that version of the app.

  • This Agreement is between you and us, not Apple. Apple is not a party to it and is not responsible for the app or its content.
  • Maintenance and support are ours. Apple has no obligation whatsoever to furnish any maintenance or support for the app. Support is at [email protected].
  • Warranty. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are ours alone.
  • Product claims. We, not Apple, are responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy legislation.
  • Intellectual property claims. If a third party claims the app infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with any applicable third-party terms of agreement when using the app, including your wireless carrier's.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of it Apple has the right, and is deemed to have accepted the right, to enforce it against you.

15. Suspension and Termination

You may end this Agreement at any time by cancelling any subscription with Apple and deleting the app, and you may close your Claimable account, which deletes your drives and your logbook as section 9 describes. We may suspend or terminate your access if you breach this Agreement, and immediately in the case of a breach of section 4.

Ending this Agreement does not end your obligation to keep the records a tax authority requires of you, which for a Canadian return is generally six years after the return the logbook supports. Export before you close anything.

16. Changes to This Agreement

We may update this Agreement. If a change is material we will tell you in the app or by email at least 14 days before it takes effect, and continuing to use Drive after that is acceptance of it. The date at the top is the most recent revision. The figures in this Agreement, the free allowance in particular, are the app's own, and a change to one is a change to this page in the same release.

17. Governing Law

This Agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict of law rules, and the courts of British Columbia have exclusive jurisdiction over any dispute arising from it. If you use Drive outside Canada, this does not deprive you of the protection of any mandatory consumer law of your own country that cannot be excluded by agreement.

18. Severability and Entire Agreement

If any provision of this Agreement is unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force. This Agreement, together with the Claimable End-User License Agreement and the Drive Privacy Policy, is the entire agreement between you and us about the app.
